Terms of Service

These Terms of Service (“Terms”) govern your access to and use of LaunchStencil, including the website, checkout flow, customer briefs, generated plans, result pages, downloadable files, and related support services (together, the “Service”). By using the Service, you agree to these Terms.

2. Nature and scope of the Service

LaunchStencil is a software-led digital product. Based on the brief and related information you submit, the Service generates an AI-created plan and related materials (“Output”).

The Output is generated from customer-submitted brief information. You are responsible for reviewing all Output before relying on it.

3. Eligibility and authority

You must be legally able to enter into a binding contract. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.

4. Orders, payment, and Merchant of Record

  1. You choose a plan and place an order through checkout.
  2. For web purchases, Paddle acts as Merchant of Record and authorised reseller.
  3. Access to paid results is provided only after payment confirmation.

5. Delivery and digital content access

Delivery times are estimates, not guarantees, and may vary due to factors such as payment verification, technical load, and brief complexity.

  • Base and Plus plans are typically delivered about 10 minutes after payment and successful brief submission.
  • Pro AI-generated plan delivery is typically about 10 minutes after payment and successful brief submission; post-delivery support is scheduled separately.

Digital content delivery and access may begin immediately after payment confirmation and successful brief submission. By requesting immediate performance and access, you acknowledge that your cancellation rights may be affected once delivery or access starts, to the extent permitted by applicable law.

6. Support tiers

Support scope depends on the plan purchased. Base and Plus include the support level described at checkout and on the Service pages for those tiers. Pro includes the AI-generated plan delivery plus separately scheduled post-delivery support.

7. Customer responsibilities

  • You are responsible for the completeness and accuracy of your brief.
  • You must have all rights and permissions needed to submit the content and information you provide.
  • You must not provide third-party personal data unless you have a lawful basis and any required permissions.

8. Acceptable use

You agree not to misuse the Service. This includes not:

  • Using the Service for unlawful purposes.
  • Interfering with, disrupting, probing, or attempting to bypass Service security or access controls.
  • Uploading malicious code or harmful content.
  • Using the Service in ways that infringe rights of others or violate applicable law.

9. AI limitations

Output is generated using AI and may contain inaccuracies, omissions, or content that is not suitable for your context. The Service is provided as software-generated informational content and does not constitute legal, financial, tax, medical, or other regulated professional advice.

10. Intellectual property and permitted use

  • We and our licensors own all rights in the Service, including software, design, branding, and underlying systems.
  • As between you and us, you retain rights in your submitted brief.
  • Subject to these Terms and payment, you may use the Output for your internal business use and related planning purposes.

11. Availability and changes

We may update, modify, or discontinue parts of the Service from time to time. We may suspend or restrict access where reasonably necessary, including for security, abuse prevention, maintenance, or legal compliance.

12. Refunds

Refunds are governed by our Refund Policy (/legal/refunds), which forms part of these Terms.

13. Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive losses, including loss of profits, business, or reputation.
  • Our total aggregate liability for claims related to a specific order is limited to the amount paid for that order.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

14. Consumer rights

If you are a consumer, you may have mandatory rights under applicable consumer protection laws. These Terms do not limit any rights that cannot be waived by law.

15. Governing law and jurisdiction

These Terms are governed by the laws of Serbia. Disputes are subject to the competent courts in Belgrade, unless mandatory consumer law provides otherwise.
